Dear Belle — Terms of Service
Last updated: 12 August 2026
Welcome to Dear Belle.
These Terms of Service ("Terms") govern your access to and use of the Dear Belle website, including any purchases made through our online store.
By accessing or using our website, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or place an order through it.
These Terms are intended to comply with applicable South African law, including the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), the Protection of Personal Information Act 4 of 2013 ("POPIA"), and other applicable legislation.
Nothing in these Terms is intended to exclude, restrict or waive any consumer right or protection that cannot lawfully be excluded, restricted or waived.
1. About Dear Belle
Dear Belle is an online retail business offering beauty, personal-care and lifestyle products to consumers.
Trading name: Dear Belle
Email: [dearbellebusiness@gmail.com]
Website: [dearbelle.co.za]
Where required by law, the details above may also be displayed elsewhere on our website.
2. Acceptance of these Terms
By using the Dear Belle website, you confirm that:
-
You have read and understood these Terms;
-
You agree to comply with them;
-
You will provide accurate information when placing an order;
-
You will use the website lawfully;
-
You will not use the website for fraudulent, abusive or unlawful purposes; and
-
Where you enter into a purchase transaction, you agree to the terms applicable to that transaction.
If you are purchasing on behalf of another person or organisation, you confirm that you have the authority to do so.
3. Changes to these Terms
Dear Belle may update these Terms from time to time.
Updated Terms will be published on this page together with the relevant "Last updated" date.
Changes will generally apply prospectively and will not retrospectively remove rights that you have already acquired under applicable law.
Where a change materially affects an existing transaction or contractual relationship, Dear Belle will comply with any notice or other requirements imposed by applicable law.
Your continued use of the website after updated Terms have been published may constitute acceptance of the updated Terms to the extent permitted by law.
4. Website use
You may use the Dear Belle website for lawful personal and legitimate commercial purposes.
You may not:
-
Use the website for unlawful purposes;
-
Attempt to gain unauthorised access to the website or its systems;
-
Introduce malicious software, viruses or other harmful code;
-
Attempt to interfere with the operation or security of the website;
-
Scrape, copy or reproduce website content for commercial purposes without permission;
-
Use automated systems to place fraudulent or abusive orders;
-
Impersonate another person;
-
Provide false or misleading information;
-
Attempt to circumvent website security measures;
-
Use the website to conduct fraudulent transactions; or
-
Engage in any activity that may damage Dear Belle, its customers, suppliers or service providers.
Dear Belle reserves the right to restrict or terminate access to the website where reasonably necessary to protect the website, our customers, our business or third parties, subject to applicable law.
5. Products and product information
We make reasonable efforts to ensure that product descriptions, photographs, specifications, pricing and other information displayed on our website are accurate and up to date.
However:
-
Product colours may appear slightly different depending on your device or screen settings;
-
Packaging may occasionally differ from photographs;
-
Product dimensions and specifications may change where manufacturers make legitimate changes;
-
Availability may change without notice; and
-
Minor differences that do not materially affect the product may occur.
We do not intentionally misrepresent our products.
Nothing in these Terms limits any statutory right you may have where goods are materially different from their description, defective, unsafe or otherwise non-compliant with applicable law.
6. Beauty and personal-care products
Certain Dear Belle products may be designed for personal-care or beauty purposes.
Customers should read and follow all product instructions, warnings and safety information before use.
Unless expressly stated otherwise, Dear Belle does not represent that a product will produce identical results for every customer.
Individual results may vary depending on factors including:
-
Skin type;
-
Hair type;
-
Frequency of use;
-
Technique;
-
Individual sensitivity;
-
Product condition; and
-
Compliance with the manufacturer's instructions.
Customers are responsible for using products in accordance with the supplied instructions.
Where a product includes warnings, precautions or recommended usage instructions, customers should follow them carefully.
Nothing in this section limits Dear Belle's liability or obligations where applicable law provides otherwise.
7. Medical and professional advice
Dear Belle's products and website content are not intended to replace professional medical advice, diagnosis or treatment.
Information provided on our website is for general informational purposes unless expressly stated otherwise.
If you have concerns about whether a beauty or personal-care product is suitable for you, you should seek appropriate professional advice before using it.
8. Product availability
Products displayed on the website are subject to availability.
Adding an item to your cart does not necessarily guarantee that the item will remain available until checkout is completed.
If a product becomes unavailable after an order has been placed, Dear Belle will contact you and provide an appropriate solution, which may include a replacement, alternative product or refund, subject to applicable law.
9. Prices
All prices displayed on the Dear Belle website will be shown in South African Rand (ZAR) unless expressly stated otherwise.
We make reasonable efforts to ensure pricing is accurate.
However, if an obvious pricing or listing error occurs, Dear Belle may contact you before fulfilling the order.
Where a pricing error is material and the law permits cancellation or correction, Dear Belle may take appropriate action.
We will not use a pricing error provision to avoid an order where applicable law requires us to honour the transaction.
Any applicable delivery charges, taxes or other fees will be disclosed as required by law before completion of the transaction.
10. Promotions, discounts and vouchers
From time to time, Dear Belle may offer promotional discounts, coupons, vouchers or special offers.
Unless otherwise stated:
-
Promotions are subject to their specific terms;
-
Promotions may have expiry dates;
-
Promotional codes may not be combined;
-
Promotional codes may not be exchanged for cash;
-
Promotional codes may not be transferred unless expressly permitted;
-
A promotion may be limited to one use per customer or household; and
-
Promotions may be subject to stock availability.
Dear Belle reserves the right to withdraw or amend a promotion where permitted by law, including where a promotion has been affected by technical, administrative or pricing errors.
No promotion will remove a consumer's statutory rights.
11. Orders
When you place an order through Dear Belle, you are making an offer to purchase the selected products.
An automated order confirmation confirms that we have received your order request. It does not necessarily mean that the order has been finally accepted or that the products have been dispatched.
Dear Belle may decline or cancel an order where reasonably necessary, including where:
-
A product is unavailable;
-
A pricing or product description error has occurred;
-
Payment has not been successfully authorised;
-
We reasonably suspect fraud or unauthorised activity;
-
The order appears to be abusive or commercially unreasonable;
-
A technical error has affected the transaction; or
-
Fulfilment is prohibited or impractical for legal or operational reasons.
Where an order is cancelled after payment has been received, any applicable refund will be processed in accordance with applicable law and our Returns & Refund Policy.
12. Order limits
Dear Belle may impose reasonable quantity limits on products or orders where necessary.
This may occur where we reasonably suspect:
-
Resale activity;
-
Automated purchasing;
-
Stock manipulation;
-
Fraud;
-
Abuse of promotional offers; or
-
Attempts to circumvent purchase limits.
Any restriction will be applied subject to applicable law.
13. Payment
Payment must be successfully completed through one of the payment methods made available by Dear Belle.
We may use third-party payment processors to process transactions.
Dear Belle does not ordinarily receive or store your full payment-card credentials where payment processing is handled by an appropriately selected third-party payment provider.
Payment information may be subject to the privacy policies and security practices of the relevant payment provider.
An order may only be dispatched after payment has been successfully authorised or otherwise verified.
14. Payment fraud and unauthorised transactions
Dear Belle reserves the right to conduct reasonable checks where an order appears suspicious or potentially fraudulent.
We may delay, cancel or decline an order where reasonably necessary to prevent fraud or protect customers, payment providers or Dear Belle.
Where an order is cancelled following a legitimate fraud-prevention process and payment has already been received, any applicable refund will be handled in accordance with applicable law.
15. Delivery
Delivery arrangements, estimated delivery periods and applicable delivery charges will be communicated during the purchasing process or through our Shipping Policy.
Delivery times are estimates unless expressly stated otherwise.
Delivery may be affected by circumstances outside Dear Belle's reasonable control, including:
-
Courier delays;
-
Severe weather;
-
Public holidays;
-
Industrial action;
-
Incorrect delivery information;
-
Unforeseen logistical disruptions;
-
National emergencies; or
-
Other events beyond our reasonable control.
Where a statutory delivery obligation applies, Dear Belle will comply with it.
Customers are responsible for providing accurate delivery information.
16. Incorrect delivery information
If a customer provides an incorrect or incomplete delivery address, Dear Belle may be unable to deliver the order successfully.
Where additional delivery or re-delivery costs arise directly from incorrect information supplied by the customer, the customer may be responsible for those costs to the extent permitted by law.
This provision does not apply where the delivery problem was caused by an error on the part of Dear Belle or its appointed delivery provider.
17. Risk and ownership
Ownership and risk relating to products will transfer in accordance with applicable law.
Nothing in these Terms is intended to deprive a consumer of any statutory protection relating to delivery, risk or ownership.
18. Returns, refunds and exchanges
Returns, refunds and exchanges are governed by the Dear Belle Returns & Refund Policy, which forms part of these Terms.
You should review that policy before placing an order.
Our Returns & Refund Policy does not replace or limit any statutory consumer rights.
Where there is a conflict between our voluntary return rules and a mandatory statutory consumer protection, the applicable law will prevail.
19. Intellectual property

20. User-generated content
If you voluntarily submit or publish content to Dear Belle, including reviews, photographs, videos, testimonials or social-media content, you remain responsible for the content you submit.
You confirm that you have the necessary rights and permissions to provide the content to Dear Belle.
Where you provide content for potential marketing or promotional use, Dear Belle will only use it in accordance with the permission, licence or consent obtained from you and applicable law.
Dear Belle will not falsely represent that a customer endorses a product where no such endorsement exists.
21. Product reviews

Reviews should be honest and based on genuine experiences.
You may not submit:
-
Fake reviews;

22. Third-party websites and services
The Dear Belle website may contain links to third-party websites, payment providers, courier services, social-media platforms or other services.
Dear Belle does not control third-party websites and is not responsible for their:
-
Content;
-

-
Security;
-
Privacy practices;
-
Terms and conditions; or
-
Actions.
Your use of third-party services may be subject to separate terms imposed by those third parties.
23. Website availability

However, we do not guarantee that the website will always be:
-
Available;
-
Uninterrupted;
-

-

The South African government describes POPIA as establishing minimum requirements and conditions for lawful processing of personal information by public and private bodies.
Our Privacy Policy explains how personal information is collected, used, stored and protected.
26. Electronic communications
When you interact with Dear Belle electronically, including by placing an order, submitting a form or contacting us by email, you consent to receiving electronic communications relating to your transaction and account.
Electronic communications may include:

27. Electronic contracting
By placing an order through the Dear Belle website, you acknowledge that the transaction may be concluded electronically.
Electronic records, confirmations and communications may form part of the contractual record of your transaction, subject to applicable law.
ECTA specifically regulates electronic transactions and requires online suppliers to make certain transaction information and terms available to consumers.
28. Errors and omissions
We make reasonable efforts to maintain accurate website information.
Despite these efforts, the website may occasionally contain typographical errors, technical errors, outdated information or omissions.
Where an error materially affects an order, Dear Belle may take reasonable steps to correct the error and, where applicable, provide the consumer with the remedies required by law.
29. Limitation of liability
To the maximum extent permitted by applicable law, Dear Belle will not be liable for losses that are:
-
Indirect;
-
Incidental;
-
Unforeseeable;
-
Remote; or
-
Caused solely by circumstances outside Dear Belle's reasonable control.
However, nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms is intended to exclude liability or consumer rights that cannot legally be excluded under South African law.

-
Prevents you from exercising a lawful cooling-off right;
-
Prevents you from making a lawful complaint; or
-
Attempts to contract out of mandatory provisions of South African law.
Where South African law provides a consumer with a mandatory right or remedy, that right or remedy will prevail over any inconsistent provision of these Terms.
31. Indemnity
To the extent permitted by applicable law, you agree to indemnify Dear Belle against losses, claims or expenses reasonably arising from your unlawful use of the website, fraudulent activity, deliberate misuse of the website, infringement of third-party rights, or violation of these Terms.
This indemnity does not apply to the extent that the relevant loss was caused by Dear Belle's unlawful conduct or where applying the indemnity would conflict with mandatory consumer protection law.
32. Suspension and termination
Dear Belle may suspend or restrict access to the website where reasonably necessary to:
-
Protect the security of the website;
-
Prevent fraud;
-
Prevent abuse;
-
Investigate unlawful activity;
-
Protect customers; or

Please provide:

Your name;

34. Dispute resolution
Dear Belle encourages customers to attempt to resolve disputes directly with us before commencing formal proceedings.
Where appropriate, the parties may agree to use mediation or another form of alternative dispute resolution.
Nothing in this section prevents a consumer from exercising a statutory right to approach a competent court, regulator, ombud or other body where applicable.
